NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN A PRIZE.  A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.  IT IS ILLEGAL TO GIVE ANY ADVANTAGE TO BUYERS IN A SWEEPSTAKES.  VOID WHERE PROHIBITED BY LAW.

BY ENTERING INTO OR PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES, WHICH CONSTITUTE A CONTRACT, SO READ THEM CAREFULLY, IF YOU DO NOT AGREE WITH THE TERMS OF THIS CONTRACT, DO NOT ENTER THE SWEEPSTAKES.

1. SPONSOR: #HASH 710 Nectar Collector Giveaway Sweepstakes is sponsored by PharmaCann Inc. (“PharmaCann”), owner and operator of LivWell and Verilife Dispensaries.

2. ELIGIBILITY: The #HASH 710 Nectar Collector Giveaway Sweepstakes is open to all legal residents of Colorado, living in a location where such contests are not prohibited by law. All entrants must be at least twenty-one (21) years of age at the time of entry. Employees of PharmaCann Inc, and its affiliated companies, subsidiaries, sponsors, advertising agencies, and third party fulfillment agencies and their respective agents, employees, officers, directors, successors, and assigns, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible to enter. The Giveaway is subject to federal, state, and local laws and regulations and is void where prohibited. No purchase is necessary to enter. 

3. PRIZE: The winner(s) will win the following prize:

One (1) collectible nectar collector (“Prize”) will be given away by random drawing among the entries submitted prior to the Sweepstakes Deadline. Only one Prize will be awarded to any eligible individual who enters the Sweepstakes (irrespective of the number of valid entries submitted by such individual pursuant to these Rules). The approximate retail value of the Prize is $1,000. Prize value is determined by the MSRP established by the nectar collector manufacturer. The marketed prize value is based on this price at the time the offer is published and is subject to change. Prizes are not redeemable for cash, are non-transferable, and may not be substituted by the winner for another prize. No cash or other substitution may be made for the prize, except PharmaCann reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the prize is not available for any reason as determined by PharmaCann in its sole discretion. 

4. WINNERS: PharmaCann will choose one (1) customer winner in a random drawing on July 10, 2022.

5. AGREEMENT TO OFFICIAL RULES: Participation in the Giveaway constitutes a participant’s full and unconditional agreement to and acceptance of these Giveaway Terms and Conditions and the decisions of PharmaCann, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

6. ENTRY PERIOD: The Giveaway begins June 10th (the “Entry Period”) and ends on July 9th, at 11:59 PM MDT.

Entries that are submitted before or after the Entry Period will be disqualified.

7. CREATE AND SUBMIT AN ENTRY: A participant can enter the drawing by scanning the QR code on their bag stuffer or the QR code located on the banner that is displayed at the front of the dispensary. Participants do not need to enter the dispensary to scan the QR code.  Once a participant scans the QR code, they will be required to complete an online entry form by providing their name, telephone number, store location, and email address (“Entry Form”).  Please be aware that a participant’s entry into the Giveaway is not complete until the online Entry Form is complete and submitted. Please provide a valid email address as we will use this information to notify the winners. YOUR PERSONAL INFORMATION WILL NOT BE USED FOR ANY OTHER PURPOSE OR SHARED WITH ANYONE ELSE.  Entry in the Giveaway is limited to one entry form per customer per visit to any of the participating LivWell dispensaries. 

8. PHARMACANN’S RIGHTS TO ENTRIES: By submitting an Entry Form, you agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against PharmaCann or its subsidiaries on the grounds that any use of the Entry Form infringes any of the entrant’s rights as the creator of the Entry Form, including, without limitation, copyrights, trademark rights, and moral rights.

9. SELECTION OF WINNER: On July 10, 2022, one (1) winner will be selected by random drawing from entries provided by participants. Participants do not need to be present to win. PharmaCann will attempt to notify the winner via telephone call and email within two (2) days of selection.  Winner will be asked to supply proof of age. Winner will be announced on July 10, 2022. Winner must claim prize within 48 hours and arrange pick up within 14 days from the location entered. If a winner fails to respond to our notification attempts within this time or fails to meet any of the eligibility requirements or is otherwise unable to comply with the competition terms and conditions, we reserve the right to disqualify that entrant and offer the prize to the next eligible entrant and thereafter until a winner is found. 

10. PRIVACY AND PUBLICITY: Due to patient and customer privacy PharmaCann will not publicly announce the drawing winner. If a winner would like to be identified, they will be required to sign a waiver and photo release. 

11. GENERAL CONDITIONS: In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, PharmaCann may, in its sole discretion, either (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Giveaway Terms and Conditions or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. PharmaCann reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Giveaway Terms and Conditions or an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, PharmaCann reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by PharmaCann to enforce any provision of these Giveaway Terms and Conditions shall not constitute a waiver of that provision.

12. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Giveaway, entrants agree to release and hold harmless PharmaCann, and their respective affiliates, officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) any errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Giveaway;(c) printing errors; (d) errors in the administration of the Giveaway or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt of any prize. Participants further agree that in any cause of action, the Released Party’s liability will be limited to the cost of entering, if any, and participating in the Giveaway, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

13. DISPUTES: Except where prohibited, the participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Illinois. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Giveaway Terms and Conditions, participant’s rights and obligations, or the rights and obligations of PharmaCann in connection with the Giveaway, shall be governed by and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules (whether of the State of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Colorado.
